What licenses and permits are required to open a restaurant in Minnesota?

Opening a restaurant in Minnesota requires obtaining a Food, Beverage, and Lodging License from the Minnesota Department of Health (MDH) or a locally delegated public health agency. The licensing process involves a plan review for new construction, remodeling, and additions of all licensed establishments. The type of food sold and the location of the establishment will determine which state or local agency will issue the license and conduct the inspections. The license is valid from January 1 through December 31 and must be renewed annually. The license’s fee is separate from the plan review fee.

1. Food, Beverage, and Lodging License

  • Purpose: This license is required to sell food and/or beverages in Minnesota. It is issued by the Minnesota Department of Health (MDH) or a locally delegated public health agency.
  • Estimated Cost: The license fees for Category 1, 2, and 3 food establishments are $110, $245, and $385 respectively. There is also a base fee for food and beverage establishments which is $165.   • How to Register: You can apply for the license through the Minnesota Department of Health or a locally delegated public health agency. The agency responsible for providing the license is determined by the location (city or county) of your establishment. 2. Plan Review

  • Purpose: A plan review is required for new construction, remodeling, and additions of all licensed establishments. This includes temporary food services, such as mobile food units, seasonal permanent food stands, seasonal temporary food stands, and food carts.
  • Estimated Cost: For a new establishment, the plan review fee for Category 1, 2, and 3 food establishments are $400, $450, and $500 respectively. If you are remodeling an existing establishment, the plan review fees are $300, $350, and $400 for Category 1, 2, and 3 respectively.
  • How to Register: Submit your plans for review to the Minnesota Department of Health. The plans must be approved before construction begins, and you should allow at least 30 days for plan approval. More details can be found on the Minnesota Department of Health website.
